Kind Mind ("the Service") is provided by Kevin Slattery ("we", "us"). By using the Service you are contracting with Kevin Slattery and agree to these terms. By continuing to use the Service you accept these terms and any updates to them.

The Service

Kind Mind is a wellbeing app offering breathing exercises, journaling, affirmations, mood tracking, nutrition logging and reminders. Kind Mind Plus is an optional paid subscription with extra features. Kind Mind is not medical advice and is not a substitute for professional care.

Eligibility

You must be of legal age to enter a contract in your country, or use the Service with the consent of a parent or guardian.

Acceptable use

You must not misuse the Service, including:

  • using it for any unlawful purpose;
  • fraud, spam or abusive behaviour;
  • infringing anyone's intellectual property;
  • interfering with its security, including introducing malware, probing for vulnerabilities, scraping, or reverse engineering;
  • reselling or redistributing the Service or circumventing its technical limits.

Intellectual property

We retain all ownership of the Service and its intellectual property, including the software, content, documentation and branding. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal use within your plan. Content you write in the app remains yours.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Kind Mind Plus costs £4.99 per month or £29.99 per year, with a 7-day free trial. Subscriptions renew automatically until cancelled. Payment, billing, tax, cancellation and refund terms are governed by Paddle's Buyer Terms. See also our Refund Policy.

Service level

We work hard to keep Kind Mind running well, but we do not guarantee that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

Liability

To the extent permitted by law, we are not liable for indirect or consequential losses (such as loss of data or profits), and our total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence.

Suspension and termination

We may suspend or end your access to the Service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations of these terms. You may stop using the Service at any time. Data stored on your device remains under your control.

Changes and governing law

We may update these terms; continued use means you accept the changes. These terms are governed by the laws of England and Wales, and disputes will be handled by its courts.
